AGREEMENT
Upon receipt of your deposit, subject to availability and our discretion, your trip booking and contract will be made between you and registered guides under JOMMOUTDOOR. By booking a trip with us you agree to these Booking Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted on this basis. The services to be provided are those referred to in your booking confirmation.
VALIDITY
The information, dates, and pricing provided on the website are valid for current trips only. Pricing, itineraries and dates may change for future trips. The itinerary provided may change slightly throughout the course of the trip in order for us to provide the most fluid and positive trip experience.
DEPOSIT & PAYMENTS
All payment must be made in full and a sum % of it will be considered as a deposit. Each deposit % will vary according to each adventure guide’s policy.

BOOKING CONFIRMATION AND FINAL PAYMENTSÂ
Once your booking is accepted, we will issue a confirmation email with an invoice. A contract will exist between you and registered guides from the date we issue the confirmation invoice. Please refer to your booking confirmation invoice for details regarding final payments. Full payment of the balance of the trip price is due 3 days before the departure date. Please note that if you choose to skip any portion of the trip, no refunds are available (ie activities, meals, leaving early or joining late, etc).

TRIP MODIFICATIONS
The nature of this type of travel requires the need for flexibility in order for us to provide the best and most effective experience. Every effort will be made to execute all the trip activities and arrangements as noted on the itinerary. However, if necessary due to circumstances out of our control, we may alter the route, schedules, itineraries, amenities, accommodation and mode of transport without prior notice.Â
TRIP GUIDE AUTHORITY
Group trips are run by a trip guide who is the authority on all decisions that affect the health, safety, and/or well-being of participants. Any decisions made by the trip guide are considered final. If you fail to comply with a decision made by a trip guide, or interfere with the well-being or mobility of the group, the trip guide may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must, at all times, comply with the laws, customs, foreign exchange and drug regulations of all countries visited. Immediate termination of your trip may occur if at any time you engage in illegal or restricted activities, without refund. Â
ACCEPTANCE OF RISKÂ
You acknowledge and agree that participation in activities, such as adventure travel, involves inherent risks and dangers of accidents, personal and bodily injury (including death) and property loss or damage. You agree that you have considered the nature and extent of the risks involved and voluntarily choose to assume all such risks, both known and unknown, even those risks that result from the negligence of others and assume full responsibility for your participation in such activities.
INDEMNIFICATION
You agree to indemnify, defend and hold harmless JOMMOUTDOOR, its affiliates, officers, directors, employees, agents, services providers, registered guides and licensors from and against all losses, liabilities, costs (including without limitation attorneys’ fees and costs on appeal or at trial), damages, judgments, claims, of every kind and nature, to the fullest extent permitted by law, arising from or relating in any way to (i) your use of the Site, (ii) the products and services purchased through the Site, (iii) any liabilities, claims, damages and injuries arising from or related to any act or omission of a Service Provider or another third party, (iv) your conduct in connection with the Site, or (v) your violation of these Experiences Terms, the Terms of Service, any law or the rights of any third party.
EXCLUSION OF LIABILITY
JOMMOUTDOORÂ acts only as an agent for the various independent suppliers that provide accommodations, transportation, sightseeing, activities, or other services connected with this tour. Such services are subject to the terms and conditions of those suppliers. Tour Operator, registered guides and their respective employees, agents, representatives, and assigns accept no liability whatsoever for any injury, damage, loss, accident, delay, or any other incident which may be caused by the negligence, defect, default of any company or person in performing the services. We do not accept liability for any loss, damage or expense resulting from war or terrorist activities threatened or actual, riot or civil unrest, industrial action threatened or actual, weather conditions, fire, flood, drought, closures, unforeseen alterations to public transport schedules, rescheduling of aircraft or boats, epidemic or outbreaks of illness or any other event outside our control which either delays or extends or reduces the trip, or compels a change in the trip arrangements after departure. All services and accommodations are subject to the laws and regulations of the country in which they are provided. Tour Operator is not responsible for any baggage or personal effects of any individual participating in the tours/trips arranged by Tour Operator. Individual travelers are responsible for purchasing a travel insurance policy, if desired, that will cover some of the expenses associated with the loss of luggage or personal effects.
FREE TIME ACTIVITIESÂ
Any optional activities during free time that are not included in the trip price, do not form part of the trip or this contract. You accept that any assistance given by your trip guide or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and activity provider. Â
COMPLAINTS
If you have a complaint about your trip please inform your trip guide or local representative at the time of occurrence in order for them to attempt to resolve the matter. If a satisfactory outcome is not reached through these means, any further complaint should sent in writing to us at info@jommoutdoor.com within 10 days of the end of the tour.
 PHOTOS, MARKETING, AND PUBLISHING
You consent to us using images or video of you taken during the trip for advertising and promotional purposes in any medium we opt for. We assure you that we only use images or video of you for Jommoutdoor marketing purposes (ie, your photos will never be sold without your permission). You grant us royalty-free, worldwide, irrevocable license, in perpetuity to use such images for Jommoutdoor publicity and promotional purposes.Â
CAPTIONS/HEADINGSÂ Â
Headings or captions to the provisions of this Agreement are solely for the convenience, are not part of this Agreement, and shall not be used to interpret or determine the validity of this Agreement. Any ambiguity in this Agreement shall not be construed against the drafter, but rather the terms and provisions hereof shall be given their reasonable interpretation.
